The Not-So-Steady Hand at the Tiller: McCroney Loses Debate

Having dinner recently with my spritely 87-year old grandmother who has fought for women's rights all her life, I was cautioned that among the many dangers of a McCain/ Palin administration, the largest concern is, "He's very old, he could die, and then she would be President!"

In the spirit of realism, here's a brief list of the words McCain used to punch himself in the face tonight by illustrating how OLD he really is:

The Tiller - Anyone who has heard that reference more than 5 times before this debate (and isn't currently on a sailboat) can soon expect their AARP Card and monthly mailer to arrive. We know, we know, you're an old navy man. Aye, aye, old timer.

Jello - As we all know, 99% of the country's Jello is served in retirement homes. Old people love it- especially John McCain, who is mad at Barack Obama for attempting to "nail" perfectly good Jello to the walls.

Croneyism - aka the old crotchety dudes' network, of which McCain is the Senate Majority Leader.

My Friend - Sorry Mr. McCain, surely you weren't addressing Americans, but Mr. Keating of the Savings and Loan Scandal and subsequent bailout which you played a part. I must say you were a bit typecast in "exercising poor judgment." You do that a lot.

Telegraph - Hmmm... perhaps he meant "E-MAIL" but telegraph just rolls off the 72 year old tongue a little smoother. If elected, he'll be delivering vetoed tax cuts for the middle class via Pony Express.

According to the Center for Disease Control, the average life expectancy of a white male born in 1936 in the U.S.A. is 58.

McCain is 14 years past- not his prime- but his actual life expectancy. If his policies don't already scare you enough, take a good look at his running mate.

Americans have recently become enamored of Palin's small-town-mayor approach to the big-bad government. They like her because "she seems nice" and "like me" and is "pretty." Suddenly, half of America has become the lonely kid at the lunch table who dreams of the homecoming queen setting down her tray near them. Reminder to all those re-living teenage fantasies: this contest should be about policy, not popularity.

Meanwhile, McCain loves to invoke that "Rough Rider," Teddy Roosevelt approach to government- I want to remind him and the American public that Teddy's reputation for roughness and vitality might have to do with the fact he was the youngest person ever to become president.

A month from the election, McCain and Palin seem more like an old, miserable millionaire and his absentminded trophy wife.

To quote my favorite 87-year old Democrat again regarding a McCain/ Palin administration, "He's old. She's stupid. They're a dangerous combination." Is it just me, or does that seem like an un-steady hand at the tiller?

A Universidade do Estado do Rio de Janeiro (Uerj) divulgou o gabarito oficial do segundo exame de qualificação, aplicado neste domingo (14). A prova teve 62.885 candidatos inscritos, 56.637 candidatos presentes e 6.248 faltosos (9,94%).

Ministra Ellen Gracie determina que TJ paulista aplique Súmula Vinculante

A ministra do Supremo Tribunal Federal (STF) Ellen Gracie suspendeu os efeitos de uma decisão do Tribunal de Justiça de São Paulo (TJ-SP) que descumpriu a Súmula Vinculante número 9, que trata sobre dias remidos.

A cada três dias trabalhados, o preso tem direito ao desconto de um dia da pena a que foi condenado. Esses dias premiados pelo trabalho são chamados de remidos (remição) e, pelo artigo 127 da Lei de Execuções Penais, a LEP (Lei 7.210/84), são perdidos ou desconsiderados quando o condenado comete falta grave. Um novo período passará a ser contado a partir da data da infração disciplinar.

No dia 12 de julho, os ministros aprovaram uma Súmula Vinculante declarando que o dispositivo da Lei de Execuções Penais foi recepcionado pela Constituição. O texto diz que "o disposto no artigo 127 da Lei 7.210/84 foi recebido pela ordem constitucional vigente e não se lhe aplica o limite temporal previsto no caput do artigo 58".

Mesmo após a edição desse enunciado, a 7ª Câmara da Seção Criminal do TJ-SP afastou a aplicação do artigo 127 da Lei de Execuções Penais, reformou sentença de primeiro grau e restabeleceu os dias remidos perdidos por preso acusado de cometer falta grave.

Diante da decisão do Tribunal de Justiça paulista, o Ministério Público do estado (MP-SP) recorreu ao STF por meio de uma Reclamação (RCL 6541), instrumento jurídico apropriado para preservar decisões da Corte. Ao analisar o caso, a ministra Ellen Gracie concedeu liminar e suspendeu a decisão do TJ-SP.

Entre os argumentos para afastar a aplicação da Súmula Vinculante, o TJ paulista alegou que ela não poderia ser aplicada ao caso em análise porque teria sido editada após a decisão proferida contra o preso. “Ora, se a lei não pode retroagir para prejudicar o réu, menos ainda uma súmula, ainda que seja vinculativa”, disse o relator do processo no TJ-SP.

Para Ellen Gracie, esse fundamento, “em juízo preliminar, não se mostra correto”. Segundo ela, a tese de que o julgamento dos recursos contra decisões proferidas antes da edição da súmula vinculante não deve observar as súmulas, após serem publicadas na imprensa oficial, “não se mostra em consonância” com o artigo da Constituição que trata das Súmulas Vinculantes.

A ministra acrescentou que o juiz de primeira instância reconheceu, implicitamente, a constitucionalidade do artigo 127 da LEP e, por isso, decretou a perda dos dias remidos do preso. Segundo ela, “o ato que se mostrou contrário à Súmula Vinculante nº 9, a princípio, foi exatamente o acórdão do Tribunal de Justiça do Estado de São Paulo, ao não considerar recepcionada a regra do artigo 127 [da LEP]”.

Crueldade

O relator da matéria no TJ de São Paulo diz em seu voto que o dispositivo da LEP está maculado pela crueldade e que a norma não foi recepcionada pela Constituição Federal, tese acolhida pela 7ª Câmara da Seção Criminal do TJ-SP. Por esse motivo, o MP paulista alega que outra Súmula Vinculante do STF também foi descumprida pela Corte paulista, a de número 10.

Esse enunciado trata do princípio constitucional da reserva de plenário, disposto no artigo 97 da Carta da República. A reserva de plenário determina que, somente pelo voto da maioria absoluta de seus integrantes, os tribunais podem declarar a inconstitucionalidade de lei ou ato normativo do poder público.

Assim, a 7ª Câmara, um órgão fracionário do Tribunal de Justiça, teria afrontado mais uma súmula (nº 10) ao dizer que um dispositivo da LEP é inconstitucional.

Abadía trocou planos de fuga de Beira-Mar por extradição

A extradição de Juan Carlos Ramírez Abadía, entregue à Justiça dos Estados Unidos no dia 23 de agosto, foi antecipada e precedida de um acordo em que o megatraficante colombiano se comprometeu a revelar supostos planos do traficante brasileiro Luiz Fernando da Costa, o Fernandinho Beira-Mar, para tentar fugir do presídio de segurança máxima de Campo Grande (MS). O esquema veio à tona no início do mês passado, quando a Polícia Federal desencadeou a Operação X.

Depois de ter sido achacado por agentes da Polícia Civil de São Paulo, Abadía temia ser morto e pediu que o governo brasileiro antecipasse sua extradição. "Um processo normal dura, em média, dois anos. O dele levou apenas cinco meses dentro do STF (Supremo Tribunal Federal). É óbvio que teve o dedo do Executivo nisso", comentou um policial.

Abadía foi preso em São Paulo no início de agosto do ano passado e levado logo em seguida para o presídio federal de Campo Grande, o mesmo em que estava Beira-Mar. O colombiano revelou ao serviço de inteligência do Departamento Penitenciário Nacional (Depen) que Beira-Mar preparava uma fuga mediante extorsão e seqüestro de parentes de autoridades das três esferas de governos - Legislativo, Executivo e Judiciário.

Abadía começou a pedir pressa na extradição depois que, no dia 13 de abril, o presídio de Campo Grande ficou debaixo de um tiroteio por 15 minutos envolvendo um grupo armado e os agentes penitenciários. Os achaques a Abadía e toda a quadrilha dele levaram o Ministério da Justiça e concordar que para o Brasil era melhor extraditá-lo para os EUA. O STF autorizou a extradição do colombiano, mas a intenção inicial do governo brasileiro era obrigá-lo a cumprir pelo menos parte da pena de 30 anos a que foi condenado no País por formação de quadrilha e lavagem de dinheiro.

How does the mature market feel about becoming empty nesters?

· 71 percent say parenting was a wonderful experience, but it wasn't easy. 19 percent say it was more challenging than they expected.

· 26 percent say they will feel like newlyweds when their kids are gone and even more (34 percent) say they will feel closer to their spouse without the children around.

· Fifty-eight percent say they are or were emotionally ready to get the kids out of the house. Males (70 percent) are significantly more likely to be emotionally prepared than females (55 percent.)

· The older the Boomers become the more ready they are to clear the Nest. In fact 71 percent of the Boomers between 53-58 years old are emotionally ready to be Empty Nesters.

· Boomers have mixed feelings about becoming Empty Nesters. While a large percentage is neutral about the emotional impact, Boomers do feel an increase in freedom to be themselves with Empty Nesting.

· Most (at least 75 percent) don't or will not miss the parenting roles, like coaching sport teams or helping with school work. But 64 percent do or will miss the family vacations.

· Getting out of debt is their Number 1 priority when becoming Empty Nesters.

· 40 percent of Boomers believe their children will be better off financially than they are.

· Only 2 percent say they wished they would not have had children.

· 46 percent would advise future parents to spend less time at work and more time with their children.

· 74 percent say they have been good role models.

· 27 percent would not let their grown children move back in with them assuming that their children were in good health and financially secure.

· 40 percent of Boomers anticipate that their adult children will move back in with them. 30 percent anticipate that their parents will move in with them.

· 28 percent would charge their kids rent, but far less (8 percent) are likely to bill their parents.

I don’t know specifically what’s going on in your life, I’m just an ordinary person; but God knows and His Word says a lot to you:

I love these scriptures a lot! As you can see, God has great plans to assure your VICTORY.

I have been waiting to tell you about an incident that happened in our house just last week. First, let me say that in order to have a Victory there has to be a battle. If there IS a loser; it doesn’t have to be you!

As I left out of prayer one day last week, I was very proud even confident that no matter what happened I would be ready for it. Everything was going good and I felt great. As I walked into my house; I had no idea that I was about to face a test. I came inside, fixed breakfast, went for a walk, got on the computer and then…BOOM! My husband opened the mail and there was a letter that really rattled him. When he told me about it I was supposed to be rattled too! It seems the bank wanted to charge us hundreds of dollars over a 57cents error. He gave the letter to me and it was my job to fix it. Smile. Fix this “hundreds of dollars problem.” He was really frustrated with me. The FIFTY SEVEN CENT DEFICIT, THAT TRIGGERED THE LETTER WAS ACTUALLY my mistake, my miscalculation. What to do? I took the paper and told my husband and son and said with confidence: “God will fix it, not to worry.” They sort of hung around waiting to see the outcome. (smile)

Now mind you…the bank was very serious. They had no plans to negotiate this matter. Did I send up a quick prayer to God telling Him to send troops or angels? NOPE….didn’t even think about it. These words began to flood my thoughts. “You Call The Manager, I’ll Call God!” Hmm, I thought; that’s the name of the book that I had started a couple of years ago. Okay, I said: “I know what to do.” So I called them up and got a very disinterested lady. I wasn’t distressed. I was very calm, expecting victory. I was thinking: “I wonder How God is going to do it (fix this problem) this time! “ I just like to marvel and smile at the way He goes about doing things right on time and may I add that I never really know how.

I knew in advance that I would have to talk to the manager as I was saying earlier, and that day I planned to talk to the CEO. I was very polite, but clear and insistent, I knew my rights. As believer’s we have certain rights too. Anyway, I was put on hold for customer service because I wouldn’t go away. They left me on hold for a very long time while they discussed my “case.” I “felt” like I was getting the runaround so I hung up. You know, sometimes “our feelings” can get us into trouble. But God is merciful. I figured that I would call them later. They called ME back to ask what happened and apologized. I talked to the Administrative Assistant to the Chief of the something or another. We had the cutest conversation. I’m so amazed; I never said the wrong thing and I made her laugh and as soon as she talked; it was obvious that I had favor.

She corrected everything and threw in some bonuses that I didn’t ask for! Oh, before I got off the phone, I PRAISED, I SHOUTED! I THANKED GOD! She was a born again believer! No coincidence! None.

Even afterwards, I was bold, I made it clear WHO did this and why it was done! When my next test comes (and it will) I will REMIND the devil of this Victory and I will RESIST him and tell him he can’t hurt me or anybody that I know in the Name of Jesus. Don’t get me started and try and stop me! I’ve got authority as a believer and so do you! Please understand that the purpose of this letter is not because I want to broadcast everything that happens to me; but to help you to relate these issues to whatever you face. I just want to encourage you to DEMAND YOUR RIGHTS…SERVE NOTICE because; …YOUR VICTORY IS NOT AT HAND, IT IS ALREADY HERE, YOU JUST HAVE TO CLAIM IT . “Victory is mine, Victory is mine” , you know the song!

Menor é morto com tiro de espingarda

Dois menores, um de 15 e outro com 16 anos, são autores e co-autores de mais um bárbaro crime na cidade de Capixaba. Eles assassinaram com um tiro no abdome o trabalhador José Santos de Souza, 40. O crime premeditado aconteceu na noite de quarta-feira, no ramal do Roseno, quando a vítima estava em pleno exercício da profissão já que era caseiro.

Segundo uma testemunha que afirma ter sido muito ajudada pela vítima disse no local do crime que os menores viviam afirmando que acabariam com a vida do caseiro. Ele disse que José Santos não leva a sério o que ela contava e achava que aqueles garotos estavam apenas blefando e que não cumpririam as ameaças, estariam apenas tentando amedrontá-lo.

Na noite de anteontem os acusados teriam tomado posse de uma espingarda e chagando onde o trabalhador estava um deles teria afirmado que daquela noite ele não passava, pois estavam cansados da presença do caseiro. Um deles que teria sido o de apenas 15 anos apontou a arma e detonou um tiro de maneira covarde atingido em cheio o abdome e peito da vítima que não teve como reagir.Folha do acre

Ohio Congresswoman, Stephanie Tubbs Jones, Dies at 58

Rep. Stephanie Tubbs Jones, a key figure in Ohio Democratic politics and the chairman of the House ethics committee, died yesterday at a Cleveland hospital after suffering a brain hemorrhage.

Police found the 58-year-old lawmaker unconscious behind the wheel of her car Tuesday night after they noticed it swerving. She was taken to Huron Hospital in East Cleveland for treatment.

Tubbs Jones "collapsed when she suffered a very serious brain hemorrhage caused by an aneurysm that burst in an inaccessible part of her brain," Gus Kious, president of Huron Hospital, said at an afternoon news conference.

Tubbs Jones died at 6:12 p.m., according to a statement issued by her family and the hospital. Several news organizations, including washingtonpost.com, erroneously reported earlier yesterday that Tubbs Jones had died based on information from anonymous sources and retracted those reports after Kious's appearance. Based on the reports, Sen. John F. Kerry (D-Mass.) sent out a statement lamenting Tubbs Jones's passing.

Michael Lim, an assistant professor of neurosurgery at Johns Hopkins University School of Medicine, said that "patients can recover after a bad brain aneurysm" but that Kious's statement had described a "very poor prognosis."

Before the announcement of Tubbs Jones's death, a prayer vigil was held in the Capitol. Rep. Dennis J. Kucinich (D), who represents a neighboring district, said he and his wife were traveling from Washington to Cleveland "to offer comfort and support to her family."

Tubbs Jones represented Ohio's 11th District, which includes eastern Cleveland and nearby suburbs, since 1998, and she was the first African American woman to represent the state in Congress. Under state election laws, Cuyahoga County Democratic officials will choose a replacement for her on the November ballot.

During this year's primaries, Tubbs Jones emerged as one of Sen. Hillary Rodham Clinton's strongest supporters in Ohio and in the Congressional Black Caucus, despite pressure from some quarters to back Sen. Barack Obama. But Tubbs Jones held her ground through the Ohio primary in March, which Clinton won by 10 points.

Tubbs Jones endorsed Obama in June after Clinton ended her campaign. Like all congressional Democrats, she was scheduled to serve as a superdelegate at the party's national convention in Denver next week.
